I got my new MP40 the other day and there was orange plastic shaped cone with a couple of tabs on th side. Does anyone know what it is for?

Its actually supposed to be a flag marker for an empty chamber.
I always use these to transport my firearms to and from the range. Sure indicator that it's emty and safe without having the slide locked back.
It's a good idea to use the chamber indicator whenever you ship or take your gun in for service, as the person opening the case can immediately see that the gun is empty. Not a good idea to throw it away.
That's interesting. I don't recall my recently purchased MP40 having one of those. Hmmm. I just can't shake this gut feeling that my MP40 was a "return" to the store -- that someone bought it but brought it back without firing it (maybe because of the gritty trigger). Maybe I'm just paranoid. (with all those people out to get me, I can't help it ).

It's a new gun. Could not do the ATF paperwork for a new original sale and again list the same SN for the sale of another new gun.

 Look under the padding and I bet you a nickel it's with the lock between the case and padding.
Doh!, BStock, you are correct, sir! Right there under the foam. I just wonder how it got there instead of being in the gun? I'm pretty sure it was not in the gun when I opened the box, and I certainly would not have stuffed it under the foam. I'm telling you, it is the work of "those people" who are out to get me.

So they don't actually put them IN the guns at the factory, just in the box?

That is correct. Just where you found it.
OK maybe you are not supposed to resell a gun that has gone through the atf check again as new. But the atf only asks what type of gun you are buying(handgun, long gun or shotgun). I don't believe that they ask for model and serial number. And even if they did, the records are "supposed" to be destroyed within 24 hours of the atf check. No where on the atf check does it ask for new or used either.......

The receipt states if it's new or used. Please let this go KITESTIR so snscott can have a nice weekend and not wonder if he got someones returned pistol.

You have a brand new virgin pistol snscott. Everything was packed as it should be and all is well. Don't forget to send for your free range bag. If you don't know about the promotion I will post a link. It's a nice S&W bag. Enjoy and don't listen to the voices that tell you otherwise. Don't trust the voices. All in good fun snscott

It’s not paranoia if everyone truly is out to get you.
